Upon acceptance by Foreclosure List Service (FLS), this will constitute a
binding agreement between the undersigned (Subscriber) and FLS, on the
following terms and conditions:
1. Subscriber expressly agrees that the information provided is the proprietary
property of FLS and shall at all times maintain the confidentiality of such
information. The information provided subscriber is for the exclusive use of subscriber
only. Authorization for conveyance in any manner to third parties is expressly
prohibited. Subscriber is further expressly prohibited from the resale or
redistribution of any or all information received from FLS.
2. Subscriber is prohibited from publicizing or advertising that they have
access to or can provide foreclosure information.
3. In the event Subscriber utilizes the information received from FLS other
than authorized herein, each such unauthorized usage shall obligate subscriber
to pay FLS damages as prescribed by law, including, but not limited to, costs
of litigation and reasonable attorneys fees.
4. Every effort is made by FLS to ensure accurate transcription of information
taken directly from public records. However, FLS makes no guarantee, express or
implied, as to the accuracy or completeness of information. All information
must be verified by Subscriber. FLS shall not be liable for damages of
any kind arising from inaccuracies. Subscriber shall hold FLS harmless from
any damage, claims, causes of action, expenses or attorneys fees asserted
against or incurred by FLS as a result of Subscriber's use of any information
furnished by FLS.
5. Service shall be on a monthly subscription basis. Cost of service shall
be either $39 per month (one report) or $49 per month (all three reports), in
advance, due and payable no later than the first of the month, for information
from the upcoming month.
